By accessing and using Pickleball Agent.ai ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Pickleball Agent.ai provides a platform for pickleball players to connect, schedule games, find courts, and track their performance. The Service uses AI-powered matching to connect players with similar skill levels and availability.

3. User Accounts

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information
• Maintain the security of your password and account
• Promptly update your account information
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

4. User Conduct

You agree not to:

• Use the Service for any unlawful purpose
• Harass, abuse, or harm other users
• Impersonate any person or entity
• Upload or transmit viruses or malicious code
• Interfere with or disrupt the Service
• Collect or store personal data about other users
• Use automated systems to access the Service

5. Content

You retain ownership of any content you submit to the Service. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display your content in connection with the Service.

We reserve the right to remove any content that violates these terms or is otherwise objectionable.

6. Subscription and Payment

Some features of the Service require a paid subscription. By subscribing, you agree to:

• Provide current and accurate billing information
• Automatic renewal unless cancelled
• No refunds for partial subscription periods

7. Cancellation

You may cancel your subscription at any time. Cancellation will take effect at the end of your current billing period. We reserve the right to terminate or suspend your account for violations of these terms.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. USE OF THE SERVICE IS AT YOUR OWN RISK.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

10. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, liabilities, and expenses arising from your use of the Service or violation of these terms.

11. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of material changes via email or through the Service. Continued use after changes constitutes acceptance of the new terms.

12. Governing Law

These terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

13. SMS Program Terms

Pickleball Agent is a text-message-based service. You opt in by texting the keyword PLAY to (805) 303-2301, or by providing your mobile number through the Service and agreeing to receive texts. These SMS Program Terms apply to all text messages sent and received in connection with the Service.

• Program description: You will receive recurring automated text messages, which may include player matches, game invites, court booking confirmations, schedule reminders, and account/service notifications.
• Message frequency: Frequency varies based on your activity, location, and preferences and may include multiple messages per week.
• Cost: Message and data rates may apply. Consent to receive texts is not a condition of purchasing any goods or services.
• Opt-out: Reply STOP at any time to cancel. After you send STOP, we will send one final message confirming your opt-out, and you will receive no further messages from us. You may continue to receive texts for a short period while your request is processed.
• Help: Reply HELP for assistance, or contact us at legal@pickleballagent.ai.
• Supported carriers: Major U.S. wireless carriers are supported. Carriers are not liable for delayed or undelivered messages.
• Eligibility: You must be at least 18 years old, or the age of majority in your jurisdiction, and the owner or authorized user of the mobile number provided, to opt in to the SMS Program.
